• Product Description: The products offered are described in detail on the website. Images are for illustrative purposes only and may not exactly represent the final product. Customers may select size and color, but it is not possible to modify the design or print.

• Prices and Payments:

  • Product prices are indicated in Euros (€) and include VAT.

  • Payment can be made through the methods indicated on the website.

  • TOSHI LUKE reserves the right to modify prices at any time, but such changes will not apply to orders already confirmed.

• Shipping:

  • Shipments are made through Printful, a print-on-demand service. This means that products are made to order after the customer has placed an order.

  • Order processing and production times vary depending on the product and destination. Delivery times and shipping costs are indicated at the time of order and may vary depending on the destination.

  • TOSHI LUKE is committed to respecting the indicated delivery times, but is not responsible for any delays due to force majeure, courier problems, or production delays on the part of Printful.

• Returns and Refunds:

  • Right of Withdrawal: In accordance with Directive 2011/83/EU, the user has the right to withdraw from the purchase contract within 14 days from the date of receipt of the products, without having to provide any reason.

  • Conditions for Return:

    • Products must be returned intact, unused, unwashed, unworn (except for the time strictly necessary to try them on) and in their original packaging, complete with all accessories and labels.

    • Due to the on-demand production model, please note that returns for "buyer's remorse" (i.e., if the customer changes their mind and no longer wants the product) may not be accepted.

    • TOSHI LUKE will accept returns or replacements for defective products or in case of a production error by Printful. In such cases, the user is required to report the problem within a reasonable time from discovery and provide photographic evidence of the defect or error.

    • The user is liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

  • Return Procedure:

    • To exercise the right of withdrawal, the user must inform TOSHI LUKE of their decision to withdraw from the contract by means of an explicit declaration (e.g., letter sent by post, fax, or email) or through the return form available on the website.

    • The communication must be sent before the expiry of the withdrawal period.

    • The user must return the goods to TOSHI LUKE without undue delay and in any case within 14 days from the day on which they communicated their decision to withdraw from the contract.

    • The direct costs of returning the goods are borne by the user, unless otherwise indicated.

  • Refund:

    • Once the returned products are received and their integrity verified, TOSHI LUKE will refund the amount paid by the user, excluding shipping costs, within 14 days from the day on which it was informed of the user's decision to withdraw from the contract.

    • The refund will be issued using the same means of payment used by the user for the initial transaction, unless otherwise indicated by the user.

    • TOSHI LUKE may withhold the refund until it has received the goods or the user has provided proof of having sent back the goods, whichever situation occurs first.

• Intellectual Property: All content on the website (text, images, logos, designs, etc.) is the property of TOSHI LUKE and is protected by Italian and European laws on copyright and intellectual property. Customers may not use TOSHI LUKE's designs for commercial purposes or to create their own products.

• Limitation of Liability: * TOSHI LUKE is liable for any lack of conformity of the products sold, as provided by the Consumer Code (Legislative Decree 206/2005). * TOSHI LUKE is not liable for any indirect or consequential damages arising from the use of the website. * TOSHI LUKE is not liable for any problems arising from the Wix platform, including website malfunctions or service interruptions.

• Changes to the Terms: TOSHI LUKE reserves the right to modify these Terms and Conditions at any time. Changes will be published on the website and will take effect immediately.

• Applicable Law and Jurisdiction: * These Terms and Conditions are governed by Italian law. * For any dispute with a consumer, the competent court will be that of the place of residence or domicile of the consumer, as provided by the Consumer Code. * For any dispute with a non-consumer user, the competent court will be the Court of Pesaro.
